We Know the Local Courts

We represent clients who have been arrested and charged on all the roads and highways throughout Massachusetts including Routes 95/128 and 495, Route 1, Route 2, Route 3, Route 6, Route 9, Route 20, Route 24, Route 190, Route 290, the Massachusetts Turnpike, and the Southeast Expressway. 

Of the 351 towns and cities in Massachusetts, every county - and each courthouse - has its own way of doing things.  The Westborough District Court, for example, prohibits a defendant from accepting a plea bargain on the day of trial.  Their viewpoint is that the cost to the Commonwealth of preparing or conducting a trial is such that you shouldn't benefit from dragging your feet.  Wait too long and the deal is off the table!  Other courts don't have such a policy. 

Individual police departments vary in their policies and procedures as well.  For example, some videotape the booking process while others do not.

This review of the facts and circumstances of your arrest puts our legal team in a much better position to argue your case to the Prosecutor - and later on to the Judge and jury - if a trial or Registry Hearing is ever held.

The moment we begin representing you, our attorneys start asking questions: 

  • Was your car stopped illegally? - What reason were you given by the police officer as to why he or she stopped you?
     
  • Did the police officer actually see you driving? - In Massachusetts, you must be operating a motor vehicle on a public way (a private parking lot is not considered a public way and in some cases your case could end-up dismissed).
     
  • What was the weather like at the time of your arrest? - If you took field sobriety tests, our DUI Defense Attorneys can use weather reports to show that high winds, poor visibility, or other bad conditions may explain the driving at the time of your stop and subsequent arrest.
     
  • Did the police officer observe you for a continual 15 minutes before giving you a breathalyzer test? - Recent case law indicates that one officer must observe a suspect for a continual period of time in order for the test results to be considered admissible.  

As we build your full case strategy, an emphasis is put on advancing the  best defense possible.  These are just a few examples of the methods we'll use in defending you, understanding how specifics can vary significantly depending on what's transpired in your own case: 

  • Review the booking videotape.  If there's a tape, and you aren't stumbling or incoherent, a jury may find you innocent.  Some police departments videotape the booking process; others don't.
     
  • File a Motion to Suppress the evidence against you.  If we can prove  improper police conduct or flawed tests, we can have all the evidence thrown out of court. 
  • Conduct extensive cross-examination of the police officer.  Officers often fail to follow their own training manual.  When on the stand, they tend to tell the portion of the story that puts the Commonwealth in the best light; our job is to expose the entire story to the Judge or jury. 

It takes a seasoned, well-versed DUI lawyer to know how to conduct this type of investigation and successfully fight a DUI charge. 

Even if a successful defense is not possible and the Commonwealth's evidence is just too strong and unfavorable to you, our attorneys will work hard to minimize the consequences you face.  Depending on your specific case, it may be possible to negotiate a lesser charge.

Legal Fees

Every law firm or attorney has something to offer that sets him or her apart from the others.  For some, it's low fees.  For others, it's a strong reputation and skills to match.  

It's a fact of life - you won't find both traits in the same lawyer.  If its low fees that you're looking for, don't expect exceptionally high skills.  Once in a while, however, you'll find aggressive and competent OUI/DUI representation for far less than the standard $5,000.00-$7,500.00 retainer. 

When potential new clients first call us, we're usually asked, "How much should I expect to pay?"  Unfortunately, there's more to the question than one would think.  The answer is, "It really depends…" 

Our Boston, North Shore, Worcester, Springfield, and South Eastern Massachusetts DUI Defense Attorneys charge flat-fees in four stages - arraignment, RMV Hearing, pretrial and trial - starting at $1500 each with most in the $1750 to $2500 range based on the Court and seriousness of the charges. 

One thing is for sure.  You always know your full cost up-front.  In addition, if you don't want to go all the way to trial, you don't have to pay for trial.
