OUI-UNDER 21
The Commonwealth of Massachusetts has a "zero tolerance" policy for underage drinking and driving, and harshly punishes the consumption of alcohol by persons under the age of 21.
Perhaps the most significant difference with underage drinkers is that charges for operating a motor vehicle are triggered with a blood alcohol concentration (BAC) of .02% or greater, whereas drivers aged 21 years only face a legal limit of .08%. Law enforcement officials and Prosecutors take underage OUI cases seriously:
- If drivers are under 21 and have a BAC of .02% or greater, their license will be suspended;
- Drivers under 21 have their driver's licenses suspended for one year if they refuse a breath test.
