REGISTRY (RMV) HEARINGS 

When you're charged with drunk driving, you're actually being prosecuted twice.  First, you're charged with the crime of OUI in the criminal courts.  Second, the Registry of Motor Vehicles (RMV) prosecutes you in an administrative proceeding presided over by one person who is both Judge and Prosecutor.  The RMV Hearing Officer wants to take your driver's license away for a minimum of 30 days.  Learn more about Melanie's Law and Penalties here.


Time is Of the Essence!

If you refused to take a breathalyzer test after being arrested for OUI in Massachusetts, or the results of your test were .08% blood alcohol content (BAC) or more (.02% for drivers Under 21), your driver's license will be suspended immediately.  Your attorney can take appropriate action to demand an RMV Hearing within 15 days after the arrest. 

At the RMV Hearing, the Defendant's right to retain driving privileges will be vigorously fought.  If unsuccessful, alternate plans for a Hardship License will be made, along with those associated with the Ignition Interlock Device and Alcohol Education Classes

Many people think that if they failed their breath test - or if they refused to take a test - they will automatically have their driver's license revoked.  This is not true.  There are numerous technical defense strategies - including the failure of law enforcement to strictly comply with proper procedures - that can result in suspensions being set aside.
