OUT-OF-STATE DUI
If you were arrested for DUI/OUI out-of-state, you are probably wondering what you should do next. While it's complicated for anyone to have to deal with a legal matter in another state, you'll be surprised to know that there are some things that can be done to minimize the amount of time you'll spend dealing with these drunk driving charges.
If You Are a Massachusetts Resident Who Was Arrested Out-of-State…
If you are licensed in Massachusetts and you are convicted of a drunk driving-related offense in another state, Massachusetts will take steps to suspend your license if it learns of the out-of-state conviction. If your Massachusetts license is suspended or revoked due to a suspension or revocation in another state, you must have your right to drive in that state reinstated before you can resolve any suspension or revocation in Massachusetts. Before you will get your driving privileges back, you will first need to bring either a reinstatement letter or current driving record from the state of suspension to any Registry of Motor Vehicles (RMV) office.
If You Were Arrested in Boston, Massachusetts And Live In Another State…
Massachusetts only has the authority to suspend your right to drive in the Commonwealth of Massachusetts. While Massachusetts is not one of the 45 states that are members of an agreement known as the "Driver License Compact," which is an agreement between states to share license information and convictions of OUI/DUI, Massachusetts does notify other states of convictions as well as breath test refusals.
When your home state learns of any suspension imposed by Massachusetts, it is likely to suspend your license for at least the same period that the Massachusetts RMV did - and may impose an even longer suspension depending on the laws of your state.
There are many things that can be done to prevent the suspension of your driver's license and even a conviction. Although out-of-state OUI/DUI cases seem complicated, our DUI Defense Attorneys can help you:
