OUI AFTER SUSPENSION
In Massachusetts, it is against the law to drive while your license is suspended. Accordingly, when a driver is arrested for drunk driving while his or her license is already suspended, they can be charged with two crimes at once: 1) Repeat Offender OUI, and 2) OUI with a suspended license.
Our DUI Defense Attorneys tell clients not to risk being arrested for Operating After Suspension when our DUI Defense Attorneys may be able to get your license reinstated or get you a Hardship License. Under the penalties of Melanie's Law, if you are convicted of driving on a license that has been suspended for OUI, there is a 60 day minimum mandatory jail sentence and a $2,500-$10,000 fine.
