CHILD ENDANGERMENT
With the passage of Melanie's Law on October 28, 2005, Massachusetts increased the penalties and sanctions for all levels of OUI convictions. Accordingly, effective on January 1, 2006, one of those new aspects of the Bill made it a separate crime for anyone to operate a motor vehicle - including, but not limited to, cars, trucks, and boats - while under the influence of alcohol or drugs with a child who is 14 years or younger.
This offense is charged in addition to the primary OUI-related charges.
The penalties associated with this are severe. Along with penalties from their other charges, first time offenders are fined a minimum of $1,000, lose their driver's license for one year, and are sentenced to 90 days in a house of correction. Repeat offenders face felony charges, pay higher fines, lose their driver's license and are sentenced to prison for up to five years.
